1. Who We Are

Tesseract Gems is a handcrafted jewelry business owned and operated by an individual artisan based in Hawaii. Our website is located at www.tesseractgems.com.

By visiting our site, placing an order, or participating in any of our live sales events, you agree to these Terms of Service. If you don't agree, please don't use the site.

2. What We Sell

Tesseract Gems sells one-of-a-kind, handmade baroque pearl jewelry and various home decor items. Every piece is unique. No two items are identical, and we cannot reproduce most pieces once it has sold.

We sell through two channels:

• Website (tesseractgems.com): Full retail pricing. Collectable items are listed after our live shows.

• Instagram Live Shows (every 1st and 3rd Thursday, 4pm HST): Live-only pricing and access to pieces not listed on the website before the live show. Studio Drop pieces are sold exclusively during live shows and will never be listed on the website.

3. Purchasing & Checkout

Guest Checkout: You don't need an account to purchase. Simply add an item to your cart and check out as a guest.

Pricing: Prices are shown in USD. Website prices are full retail. Live-show pricing is separate and only available during the live event.

Order Confirmation: You'll receive an email confirmation after a successful purchase. That confirmation is your receipt - please save it.

Availability: Because all pieces are one-of-a-kind, once an item sells, it's gone. An item in your cart is not reserved until your payment is fully processed and confirmed. If a piece sells before your transaction completes, we'll notify you and issue a full refund.

4. Payment

We accept the following payment methods:

• Online (website orders): Credit/debit card via Stripe and PayPal

• Live sales (Instagram Live shows): PayPal and Venmo

All transactions are processed securely through our payment providers. Tesseract Gems does not store your full payment card details. By submitting a payment, you confirm that you are authorized to use the payment method provided.

Live Sale Payments: If you win a piece during a live show, payment is expected promptly after the show concludes unless we have made a specific arrangement with you in advance. Unclaimed or unpaid pieces will be made available to the next interested buyer (see Section 7 on Live Sale Claims below).

5. Shipping

We ship from Hawaii via USPS. Shipping costs are calculated at checkout based on your location and the weight of your order.

Processing Time: Most orders are packaged and shipped within 3–5 business days of purchase. During peak periods (October and December), processing may take a few days longer - we'll communicate any delays.

Holiday Shipping Cutoffs: During the December season, we publish safe-order deadlines in our Stories and on site. Orders placed after those dates may not arrive by Christmas. We are not responsible for carrier delays once a package has left our hands.

Lost or Delayed Packages: Once we hand a package to USPS and provide you with a tracking number, the shipment is in the carrier's hands. We'll do our best to help you resolve any issues, but we cannot be held responsible for carrier delays, lost packages after confirmed delivery, or packages lost due to an incorrect address provided at checkout.

6. Returns, Refunds & Damages

Because every Tesseract Gems piece is handmade and one-of-a-kind, all sales are final. We do not accept returns or exchanges except in the case of damage during shipping.

Damaged Items: If your order arrives damaged, please contact us within 48 hours of delivery at tesseractgems@protonmail.com with:

• Your order number

• A photo of the damaged item

• A photo of the packaging

We review damage claims on a case-by-case basis. Depending on the situation, we may offer a repair, partial refund, or full refund at our discretion. We reserve the right to request that the damaged item be returned before issuing a resolution.

We are not responsible for:

• Damage caused after delivery

• Items lost due to an incorrect shipping address you provided

• Natural variation in handmade pieces (slight color differences, organic pearl shapes, etc.)

Live Sale Pieces: Studio Drop pieces sold during live shows are final sale with no exceptions. These pieces are never listed on the website and cannot be replaced.

7. Live Sale Claims & Hold Policy

Our Instagram Live shows operate on a first-come, first-served basis. Here's how it works:

• A piece is claimed when you comment during the live show, and we verbally acknowledge your claim on camera.

• A verbal or chat claim is a commitment to purchase. Claiming a piece and not following through with payment is a breach of good faith and will affect your ability to participate in future live sales.

• Unclaimed pieces (no payment received within 24 hours of the show ending, or by any other deadline we state during the show) will be released to the next interested buyer or, for Ghost Drop pieces, listed on the website at full retail.

• We do not honor claims made after a piece has already been acknowledged as claimed by another buyer, regardless of what the live chat shows. Our verbal acknowledgment on camera is the official record.

• We reserve the right to decline sales to buyers who have a history of non-payment or chargebacks.

8. Intellectual Property

Everything on this site - photos, product descriptions, the Tesseract Gems name, "Emporium No. 13: The Land of Misfit Pearls," "Join the Tiny Rebellion," all copy, artwork, and branding - is owned by Tesseract Gems and protected by copyright and/or trademark law.

You may not:

• Copy, reproduce, or redistribute our images or content without written permission

• Use our brand name, logo, or product photos for commercial purposes

• Claim our original work as your own

Sharing our content on social media for personal, non-commercial use (e.g., tagging us in a post showing your new piece) is welcome and appreciated. 🖤

9. Limitation of Liability

Tesseract Gems is a small, independent, handcrafted business. To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages arising from your use of our site or products.

• Our total liability for any claim related to a purchase will not exceed the amount you paid for the specific item in question.

• We make no warranties - express or implied - beyond what is stated in these Terms. All items are sold as-is, with the understanding that handmade goods may have natural variation.

Nothing in these Terms limits liability for gross negligence, fraud, or anything that cannot be limited under Hawaii law.

10. Disclaimer

Our website and products are provided "as is." We do our best to accurately represent each piece through photography and descriptions, but please be aware:

• Colors may appear slightly different on different screens.

• Baroque pearls are natural materials and will have organic variation in shape, luster, and size - this is a feature, not a flaw.

• Measurements are approximate.

If you have specific questions about a piece before purchasing, please reach out before you buy.

11. Dispute Resolution

We'd rather solve any problem directly. If something goes wrong with your order, please contact us first at tesseractgems@protonmail.com or DM me on Instagram and give us a chance to make it right.

If we can't resolve a dispute informally, these Terms are governed by the laws of the State of Hawaii, and any legal proceedings will take place in Hawaii courts. By using this site, you consent to that jurisdiction.

12. Termination / Right to Refuse Service

We reserve the right to refuse service to anyone at any time, including but not limited to buyers who:

• Have a history of non-payment following live sale claims

• Have filed fraudulent chargebacks

• Have been abusive toward us or our community

This applies to both website purchases and participation in live shows.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect any changes. Continued use of the site after changes are posted means you accept the new terms.
